Hello. I am considering selling my rental property but I have an IRS lien against my name/SSN. However, there is no lien on the property itself. If I sell the property will the lien have to be satisfied from the sale proceeds?

 

Answer:

Generally, after escrow is opened, the title agent will run searches for all liens recorded against the property or property owner to be paid before closing.  If the agent fails to run the searches correctly, the personal lien may not show up in the results, but generally all recorded liens affect the transaction.  All that said, we highly recommend that you consult with an attorney for the applicable statutes in your state.
